A case has been submitted to the Luxembourg Court of Justice about the right to legal protection and the free choice of lawyer.
The Court recalls the provisions of Directive 87/344/CEE of the Council of 22 June 1987 about the right to legal protection and to an interpreter.
The Court mentions : “Article 4, paragraph 1, under a), of the directive 87/344/CEE of the Council, of 22nd June 1987, on coordination of legislative, regulatory and administrative provisions about the right to legal protection, should be interpreted in the sense that the legal protection insurer cannot reserve the right, when a considerable number of holders of legal protection are damaged by the same event, to choose on his own the legal representative for all the insured concerned.” http://curia.europa.eu/jcms/jcms/j_6/accueil
