New members - The Consiglio Nazionale Forense
The Consiglio Nazionale Forense (National Bar Council or CNF) is the public institution representing lawyers in Italy.
Royal Legislative Decree No. 1578 of 27 November and Royal Decree No. 37 of 22 January 1934 establish the C.N.F. under Italian Law and define its structure and functions.
Pursuant to the applicable legislative provisions, the C.N.F. is based in Rome and has it seat by the Minister of Justice. It is formed by 26 members (one for each district of Court of Appeal).
The C.N.F. members are elected among the lawyers admitted to practice before the supreme jurisdictions in Italy. Their mandate lasts for three years and is renewable (the current mandate shall expire on 27 July 2010 but the current members will stay in office until the new concil is appointed).
The President, the two Vice-Presidents, the Secretary and the Treasurers are elected within the C.N.F. by its members.
A regulation governs the functioning of the C.N.F.. The following are its main competences : • Jurisdiction (appeal) : the C.N.F. has the competence for reviewing the decisions adopted by local Bars on disciplinary matters, the keeping of the register of lawyer’ register and the local bar elections ; • Keeping of the register of lawyers (Albo degli Avvocati) admitted to practice before the supreme jurisdictions ; • Consultative function on draft laws and regulations having a direct or indirect impact on the legal profession.
The C.N.F. is also consulted on the dissolution of the local bars (Consigli degli Ordini), designates the members of the boards for the professional examination, approves and coordinates the programmes of the law schools and drafts, proposes and updates the professional fee-scheme.
The C.N.F is, at the same time, the body representing the legal profession and a public administration to whom the law confers jurisdictional and administrative powers.
In this historical moment, the C.N.F., similarly to other organisation in the European region, directs its efforts to ensuring that Italian lawyers meet the necessary levels of quality and respect high ethical standards
The C.N.F. is present in all the organisations representing lawyers at the international level (CCBE -UIA) : it has representatives in Brussels, Paris and London and keeps contacts with the legal professions at the global level. Its representatives are active in all the most relevant legal committees in Italy and abroad.
The C.N.F. publishes a quarterly journal of legal culture and doctrine (Rassegna Forense) and, every two months, a review with news on the profession (Attualità Forensi). It also promotes other editorial initiatives such as the “Quaderni della Rassegna Forense”.
The current President of the Consiglio Nazionale Forense is Piero Guido Alpa.
Nouveaux membres - Le Consiglio Nazionale Forense
Le Consiglio Nazionale Forense (ci-après « le Conseil ») - prévu per le système juridique italien et réglementé par le Décret Royal (RDL) du 27.11.1933 n.1933 n.1578 et par le Décret Royal (R.D) du 22.1.1934 n.37 - est l’organisme de représentation institutionnelle de la profession d’avocat et il représente la catégorie de la profession d’avocat.
Par disposition législative, le siège du Conseil est à Rome auprès du Ministère de Justice. Le Conseil compte vingt six membres (conformément au nombre de districts de la Cour d’Appel), élus parmi les avocats admis à exercer devant les juridictions supérieures.
Les membres du Conseil sont élus pour trois ans : leurs mandat est renouvelable et il termine le 27 juillet 2010, à partir de cette date ils restent en fonction jusqu’à l’élection des nouveaux membres du Conseil. Un règlement interne discipline les travaux du Conseil. Les nouveaux membres éliront à leur tour le Président, les deux Vice-présidents, le Secrétaire et le Trésorier.
Les fonctions principales du Consiglio Nazionale Forense sont les suivantes :
(i)La fonction juridictionnelle qui permet au Conseil de juger en dégrée d’appel sur les plaintes déposées contre les mesures adoptées par le Conseil de l’Ordre sur des questions disciplinaires, de gestion des tableaux et d’élection des Barreaux ;
(ii)La gestion du Grand Tableau des avocats habilités à exercer auprès du Conseil d’Etat, du Conseil Constitutionnel et de la Cour de Cassation ;
(iii)La fonction consultative en matière de projets de loi et de réglementation directement ou indirectement concernant la profession d’avocat ;
Le Conseil peut aussi donner son avis sur la dissolution d’un Conseil de l’Ordre, désigner les avocats qui auront pour fonction d’examiner les candidats à l’habilitation à la profession, arrêter et coordonner la formation continue dans les écoles professionnelles, établir, mettre à jour et proposer les tarifs des honoraires des avocats.
Le Consiglio Nazionale Forense est l’organisme représentatif de la profession d’avocat ainsi qu’un sujet actif du système juridique. La loi lui confie des pouvoirs juridictionnels et administratifs. En tant que tel, le Conseil représente aujourd’hui institutionnellement et de façon globale la profession et, dans ce particulier moment historique, il exprime le dynamisme des Barreaux et des avocats et il se porte garant de la qualité et de l’étique professionnelle des avocats aussi dans le contexte européen.
Le Consiglio Nazionale Forense est présente auprès de tous les organismes internationaux de la profession d’avocat (CCBE -UIA) : il a ouvert un bureau à Bruxelles, Paris et Londres et entretiens les contactes avec les organismes de la profession de tout le monde. Les représentants du Conseil sont présents dans les commissions juridiques italiennes et étrangères les plus importantes. Le Conseil est responsable de la publication de la revue trimestrielle de culture et doctrine juridique « Rassegna Forense », de la revue bimestrielle « Attualità Forensi » ainsi que de « Quaderni della Rassegna Forense ».

Il Consiglio Nazionale Forense è l’organismo di rappresentanza istituzionale dell’avvocatura e rappresenta l’intera classe forense.
Il Consiglio Nazionale Forense - disciplinato nell’ordinamento giuridico italiano dal RDL 27.11.1933 n.1933 n.1578 e dal R.D. 22.1.1934 n.37 - è l’organismo di rappresentanza istituzionale dell’avvocatura ed espressione dell’intera classe forense.
Per specifica disposizione legislativa, il Consiglio ha sede in Roma presso il Ministero di Grazia e Giustizia ed è composto da ventisei membri (quanti sono i Distretti delle Corti di Appello), eletti tra gli avvocati ammessi al patrocinio avanti le magistrature superiori.
I componenti sono eletti per un periodo di tre anni : possono essere rieletti e alla scadenza del mandato (il prossimo scade il 27 luglio 2010) e rimangono in carica fino all’insediamento del nuovo Consiglio.
I lavori del Consiglio sono retti da un regolamento. All’interno dei propri componenti elegge inoltre il Presidente, i due Vice Presidenti, il Segretario e il Tesoriere ; Le principali attribuzioni del C.N.F. sono le seguenti : • funzione giurisdizionale, che si realizza nel giudicare sui ricorsi proposti avverso le decisioni degli Ordini territoriali in materia disciplinare, di tenuta degli albi e di reclami elettorali ; • la tenuta dell’Albo degli Avvocati abilitati al patrocinio innanzi le magistrature superiori ; • la funzione consultiva sui progetti di legge e di regolamento, che riguardano principalmente -direttamente e indirettamente- la professione forense.
Il C.N.F. dà inoltre il parere sullo scioglimento dei Consigli degli Ordini ; designa gli avvocati quali componenti le Commissioni di esame di abilitazione ; approva e coordina i programmi delle scuole forensi ; redige, aggiorna e propone le tariffe professionali.
Il C.N.F. è l’organo di espressione dell’ordine forense ed è contemporaneamente un soggetto dell’ordinamento statale, al quale -per legge- sono demandati poteri giurisdizionali e di amministrazione. Rappresenta l’organo di rappresentanza istituzionale e generale dell’Avvocatura ed è teso a rappresentare. in questo particolare momento storico, il dinamismo degli Ordini forensi e dell’Avvocatura per garantire la qualità professionale degli avvocati e il loro livello etico, nel quadro dell’area europea.
Il C.N.F. è presente in tutti gli organismi internazionali dell’Avvocatura (CCBE -UIA) : è rappresentato a Bruxelles, Parigi e Londra e mantiene i contatti con le avvocature di tutto il mondo : i suoi rappresentanti sono nelle più importanti commissioni Giuridiche italiane ed estere. Pubblica il trimestrale di cultura e dottrina Rassegna Forense, il bimestrale Attualità Forensi e dà vita ad iniziative editoriali, quali i Quaderni della Rassegna Forense.

Neue Mitglieder - Der Consiglio Nazionale Forense
Der Consiglio Nazionale Forense (C.N.F.) ist die italienische nationale Anwaltskammer, und vertritt alle Anwälter die in Italien professionell tätig sind.
Struktur und Funktionen des Consiglio Nazionale Forense sind gesetzlich vorgesehen (Königl. gesetzl. Dekr. 1578 vom 27.11.1933 und Königl. Dekr. 37 vom 22.1.1934).
Anhand dieser Regulierung hat der C.N.F. sein Sitz in Rom beim Justizministerium und besteht aus 26 Mitgliedern (ein Vertreter für jeden Oberlandesgerichtsbezirk), die aus allen beim Kassationsgerichtshof und bei den obersten Gerichtshöfen zugelassenen Anwältern gewählt werden.
Die Mitglieder bleiben im Amt 3 Jahre lang und sie können mehrere Mandate ausüben ; die aktuellen Vertreter werden am kommenden 27. Juli 2010 ihre Aufgabe beenden. Die früheren Mitglieder bleiben gesetzmäßig im Amt solange die neue nicht eingetreten sind.
Die Tätigkeit des C.N.F. ist durch eine Geschäftsordnung reguliert. Unter den Mitgliedern werden den Präsidenten, zweit Vizepräsidenten, einen Sekretär und einen Finanzbeauftragten Mitglied.
Die wichtigsten Aufgaben des Consiglio Nazionale sind die folgende :
richterliche Funktion im Disziplinarbereich, als Berufungsgericht für die Entscheidung der Anfechtungen der Disziplinarmaßnahmen ;
Verwaltung des Sonderverzeichnisses der Rechtsanwälte, die beim Kassationsgerichtshof und bei den obersten Gerichtshöfen zugelassen sind auf nationale Ebene ;
Beratung der staatlichen Institutionen über Gesetzes- und Verordnungsvorlagen, die mittelbar oder unmittelbar die Berufsordnung betreffen ;
Der C.N.F. ausübt weitere Funktionen : er gibt eine Stellungnahme im Falle der Auflösung einer lokalen Rechtsanwaltskammer durch den Justizministerium, ernennt die Kommissionsmitglieder für die Staatsexamen, genehmigt die Programme der Ausbildungsschulen für Lehrlinge ; verfasst die Vorlagen der Tariftabellen und die entspr. Veränderungen.
Im italienischen Rechtsordnung ist der C.N.F. gleichzeitig ein Vertretungsorgan der Anwältergemeinschaft und auch eine öffentliche Körperschaft, die gesetzmäßig richterliche und verwaltungsrechtliche Kompetenzen ausübt. Die Ziele des C.N.F. sind heute vor allem die Vertretung der gesellschaftlichen Rolle der Rechtsanwälte, die Garantie der Qualität der Berufleistungen, die Schutz der ethischen Gebote ; das alles im engen Verbindung mit der Anwaltschaften der anderen europäischen Ländern.
Der C.N.F. ist Mitglied der wichtigesten Organisationen der Anwälte auf europäische Ebene (wie CCBE und UIA), hat ein eigenes Büro in Brüssel und behält Kontakte mit Anwaltsverbänden der ganzen Welt.
Der Consiglio veröffentlicht verschiedene Zeitschriften (Rassegna forense vierteljährlich ; Attualità forensi zweimontalich) und herausgibt eigene Bücherreihen wie Quaderni di Rassegna forense.
