The general secretariat of the European Council has produced a guide to videoconference in trans-frontier legal procedure. The article aspires to help users by providing useful advice. The aim is to promote the use of videoconference, notably for hearing the testimony of witnesses and experts.
So this is about modernising justice. It would certainly be useful if the bars would take steps to facilitate this use of videoconference.
It will also be necessary to demand all necessary guarantees about this new technology. Do they offer all the necessary security ? What is the lawyer’s role and might it in fact be diminished by this new technology ? Will it preserve the attorney-client priviledge in conversations between the lawyer and his client ?
These are some of the questions we should raise about the use of this new technology.
