The European Federation of Lawyer Associations, met together in Malaga on May 3, 1996, in view of the proposal of the Commission for the professional training of the lawyer, recommends member Lawyer Associations to take measures that permit :
1. The uniformity of the conditions of access to the profession of lawyer after a minimum of four years of studies that include graduation in Law in the case of the countries in which this is necessary, or an equivalent training requirement.
2. The generalization of training schools controlled by the profession, together with an apprenticeship that lasts for at least the time passed in the training school and the following year.
3. The coordination in each country of the organization and control of an apprenticeship based on a regulation that defines its nature and content.
4. The establishment of a final examination at the end of the apprenticeship that is based on aptitude and professional experience and not on monitoring a university type theoretical knowledge.
5. The organization of apprenticeship abroad under the patronage of the European Federation of Lawyer Associations from the information supplied by the competent organizations of each country in regard to apprenticeship and the international programme.

La federazione del collegio degli avvocati europei, riunita a Malaga il 3 Maggio 1996, una volta venuta a conoscenza dell’intenzione della sua Commissione della formazione professionale dell’avvocato, raccomanda ai collegi degli avvocati membri di prendere le misure opportune che permettano :
1. L’uniformità delle condizioni di accesso alla professione dell’avvocato trascorsi i, come minimo, quattro anni di studi che comprenda la laurea in diritto nel caso dei paesi nei quali quest’ultima è considerata necessaria, o una formazione con esigenze equivalenti.
2. La generalizzazione di scuole di formazione controllate dalla professione insieme ad un tirocinio che duri quanto il tempo trascorso presso la scuola di formazione e, come minimo, l’anno successivo.
3. L’armonia dell’organizzazione e del controllo del tirocinio in ogni paese si deve basare su un regolamento che definisca la sua natura e il suo contenuto.
4. Il fatto di stabilire un controllo a tirocinio terminato deve basarsi sull’atteggiamento e l’esperienza professionale e non nel verificare un conoscimento teorico di tipo universitario.

Der Verband der europäischen Anwaltskammern, der am 3. Mai 1996 in Malaga zusammen gekommen ist, empfiehlt den Anwaltskammer-mitgliedern, nach dem Einsehen des Vorschlages der Kommission für die Weiterbildung der Anwälte, die entsprechenden Massnahmen einzuleiten, die erlauben :
1. Gleiche Bedingungen für den Zutritt zum Anwaltsberuf nach wenigstens vier Studienjahren, einschliesslich Staatsexamen im Rechtswesen in den Ländern wo dieses verlangt wird, oder nach einer entsprechenden gleichwertigen Ausbildung.
2. Allgemeine Verbreitung der beruflich kontrollierten Ausbildungsstätten und einer Praktikantenzeit, die die Ausbildungsjahre in den Ausbildungsstätten und wenigstens das nächste Folgejahr umfasst.
3. Angleichung der Organisation und der Kontrolle der Praktikantenzeit in den einzelnen Ländern, die auf einer Regulierung basiert, die den Inhalt und Beschaffenheit definiert.
4. Einführung einer Prüfung am Ende der Praktikantenzeit, die die berufliche Befähigung und Erfahrung bewertet und nicht die theoretischen Kenntnisse nach Universitätsstil.
5. Die Praktikantenzeit im Ausland mit dem Beistand des Verbandes der europäischen Anwaltskammern zu organisieren, sobald die Informationen der zuständigen Organisationen der einzelnen Länder über Praktikantenzeiten und internationale Programme vorliegen.
